Harris Beach Represents Greatbatch Ltd. in Successful Patent Infringement Lawsuit

Harris Beach PLLC has achieved a successful jury verdict for Greatbatch Ltd. following a two-week trial in which Greatbatch claimed patent infringement by AVX Corporation cost Greatbatch $37.5 million in lost sales, price erosion, and other value. The trial was held January 11 – 25, 2016 in the United States District Court for the District of Delaware. The jury awarded Greatbatch the $37.5 million in damages it was seeking.

The complaint focused on Greatbatch patents covering feedthrough filters used in implantable medical devices such as a cardiac pacemaker or cardioverter defibrillator. The technology is designed to prevent external interference signals, such as those caused by digital cellular phones, from adversely affecting the performance of those medical devices.
The jury returned a verdict finding that AVX Corporation and AVX Filters Corporation products infringe two Greatbatch patents. The jury's decision marked an important milestone in Greatbatch’s effort to defend its patented technology, which covers a range of filtered feedthrough technology.
During trial, Greatbatch presented evidence that certain AVX products infringe claims of U.S. Patent Nos. 5,905,627 and 5,333,095. In advance of trial, the court determined that the jury should also include damages for infringement of U.S. Patent No. 6,888,715. The jury verdict also confirmed the validity of Greatbatch’s asserted patents, as well as two other Greatbatch patents that AVX had challenged.
